1. Accepting these terms
These terms are an agreement between you and Web Dev NC ("we", "us") about the Eye Saver Android app and the website eyesaver.webdevnc.com. By installing or using Eye Saver, you agree to them. If you don't agree, don't use the app, and uninstall it.
You must be at least 13 years old to use Eye Saver. If you are under the age of majority where you live, a parent or guardian should review these terms with you. Google Play's own terms also apply to downloads and purchases made through Google Play.
2. What Eye Saver does
Eye Saver runs a timer on your Android phone and shows a full-screen break reminder over other apps when the timer ends. You set the interval, break length, postpone and skip limits, strict mode, and automatic pauses for calls, media, and, with Premium, apps you choose.
Eye Saver depends on Android permissions and on your phone's battery and background settings. Android or your phone maker can delay or stop the timer, and we can't control that.
3. Not medical advice
Eye Saver is a break reminder. It isn't a medical device, and it doesn't diagnose, treat, cure, or prevent any condition. The break prompts, including the 20-20-20 habit, are general suggestions for pausing screen use.
If you have eye pain, vision changes, headaches, dry or irritated eyes, or any other symptom, see an eye care professional or doctor. Skip any break prompt, such as eye movements or standing up to stretch, that is uncomfortable or unsafe for you.
5. Ads
The free version shows ads served by Google Mobile Ads. Advertisers, not Web Dev NC, are responsible for their ads and for anything you buy from them. How ads use your data is described in the privacy policy.
6. Acceptable use
Use Eye Saver only for lawful purposes. You agree not to:
- Get around Premium checks, ad rewards, or Google Play billing.
- Copy, modify, sell, or redistribute the app, except where the law allows it or an open-source license listed in the app permits it.
- Reverse engineer the app, except where the law allows it.
- Interfere with ads, for example by generating fake ad views or clicks.
- Use Eye Saver in a way that harms other people, their devices, or Google's services.
Don't rely on a break screen appearing while you drive, operate machinery, or do anything where a sudden full-screen interruption could be dangerous. Turn the timer off first.
7. Intellectual property
Web Dev NC owns the Eye Saver name, logo, app design, code, text, and this website, except for open-source components used under their own licenses. You can see those licenses in the app under Settings > About > Open-source licenses. These terms give you a personal, non-transferable right to use Eye Saver on devices you own or control.
8. No warranty
Eye Saver is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the app will run without errors or interruptions, that every break will arrive on time on every phone, or that the app will meet your needs.
9. Limitation of liability
To the extent the law allows, Web Dev NC isn't liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or productivity, arising from your use of Eye Saver or your inability to use it.
Our total liability for any claim about Eye Saver is limited to the amount you paid for Eye Saver in the six months before the claim. Some places don't allow these limits, so they may not apply to you.
10. Changes and termination
We may update these terms. When we do, we'll change the effective date at the top, and for significant changes we'll post a notice on this site before they take effect. If you keep using Eye Saver after that, the new terms apply.
You can stop using Eye Saver at any time by uninstalling it; cancel any subscription in Google Play first. We may change, suspend, or stop offering Eye Saver or any feature. We may end your right to use it if you break these terms.
11. Governing law
These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-law rules. If you are a consumer elsewhere, you keep the protections of the mandatory law where you live.
